How Do Marital Agreements Work?
Premarital and postmarital agreements are legally binding contracts that couples can enter into before or after marriage. Like other states in the U.S., Nevada follows the Uniform Premarital and Marital Agreements Act.
Premarital and postmarital agreements can include terms that stipulate:
- How the parties will divide property in the event of a divorce;
- How the parties can use property (buying, selling, transferring, etc.) during the marriage;
- What property is considered community (to be divided upon divorce) or separate (ineligible for property division);
- Whether either party can request spousal support (alimony) (in Premarital Agreements only);
- Who will get the pets in the event of a divorce;
- Other terms the parties agree to that attorneys verify don't violate public policy.
However, a premarital or postmarital agreement may be considered invalid by a court if:
- It contains terms for child support or custody;
- One party failed to properly disclose community, quasi-community, or separate property during the drafting of the agreement;
- One party did not enter the premarital or postmarital agreement of their own volition (such as being blackmailed or coerced into entering the agreement);
- The agreement contains "unconscionable" terms. Unconscionable terms are those clearly unfair to one party, or that would obviously impact a person’s life in a negative way without the other party suffering from similar ramifications.
