What Is an Uncontested Adoption?

In most cases, a child's biological parents need to consent to an adoption. When the parents agree to an adoption and give their consent to prospective adoptive parents, that adoption is called an "uncontested adoption," as the parents are not contesting it.

Who Participates in an Uncontested Adoption?

Generally, uncontested adoptions are initiated by family members of a child other than the parents. An uncontested adoption can happen for several reasons:

  • A court orders parents to give up custody of their child, and they want another family member to look after the child;
  • A stepparent wants to adopt a child, and the other biological parent agrees to the adoption;
  • Other family members want to adopt a child regardless of a court order, and the biological parents agree that adoption is in the child's best interests.
  • Biological parents either abandoned the child, or are no longer alive, and relatives are adopting the child

Generally, the relatives who want to carry out the adoption must live in Nevada for six months before they can proceed with the adoption process.

Stepparent Adoption in Nevada

Perhaps the most common type of uncontested adoption occurs when a stepparent wants to adopt a child.

If a stepparent wants to formally adopt a child and both the child's biological parents are alive, whichever biological parent isn't married to the stepparent must agree to have their parental rights terminated for the adoption to be uncontested.

To initiate a stepparent adoption, the biological parent who has custody of the child must file an adoption petition with the stepparent.
